📌 Part 2 का महत्त्वाचे आहे?

Property fraud च्या 82% cases मध्ये document verification न केल्यामुळे fraud झाले. Document verification म्हणजे केवळ documents बघणे नव्हे — तर प्रत्येक document authentic sources वर cross-verify करणे. हा Part तुम्हाला कोणते documents लागतात, ते कुठे verify करायचे, आणि fraud documents कसे ओळखायचे हे सांगेल.

1. Property Documents — सम्पूर्ण Overview

Property खरेदी करताना दोन प्रकारचे documents असतात: (A) Title Documents — property ची मालकी सिद्ध करणारे, आणि (B) Supporting Documents — property ची legal status, physical details, आणि approvals सांगणारे.

2. 7/12 उतारा (Satbara Utara) — विस्तृत माहिती

7/12 उतारा हे महाराष्ट्रातील ग्रामीण जमिनीचे सर्वात महत्त्वाचे document आहे. “7/12” म्हणजे Maharashtra Land Revenue Code च्या Form 7 (खाते नोंद) आणि Form 12 (लागवड नोंद) यांचे combination. हा Taluka Revenue Office (Talathi) कडे असतो.

2.1 7/12 उतारा मध्ये काय असते?

Portal उघडा: bhulekh.mahabhumi.gov.in — हे Maharashtra Government चे official land records portal आहे.

Region Select करा: Amravati, Aurangabad, Konkan, Nashik, Pune, Nagpur — यापैकी योग्य region select करा.

District, Taluka, Village Select करा: जमीन कुठे आहे ते select करा.

Search Type निवडा: Survey Number, Khata Number, किंवा मालकाचे नाव यापैकी एकाने search करा.

7/12 पहा आणि Compare करा: Online 7/12 आणि Seller ने दिलेला 7/12 compare करा. नाव, area, survey number जुळतात का?

Digitally Signed Copy Download करा: Portal वरून Digitally Signed 7/12 download करा — हे court मध्ये valid आहे.

3. Property Card — शहरी जमीन नोंद

Property Card (City Survey Record) हे शहरी भागातील जमिनीचे सरकारी record आहे. Municipal Corporation / Nagarpalika क्षेत्रात असलेल्या properties साठी 7/12 ऐवजी Property Card वापरले जाते.

3.1 Property Card मध्ये काय असते?

City Survey Number: शहरातील unique property identification number
Owner’s Name (मालकाचे नाव): Current owner च्या नावाची नोंद
Area: Plot area (sq meters किंवा sq feet)
Class of Occupancy: Freehold, Leasehold, Government lease
Encumbrances: Mortgages, liens, court orders
Mutation History: मागील owner changes

3.2 Property Card Online Verification

Mumbai साठी: mcgm.gov.in — Greater Mumbai Municipal Corporation portal. City Survey Number enter करून Property Card पहा.

Pune साठी: pmccare.in — Pune Municipal Corporation portal. Property details, tax dues, ownership records.

Nagpur साठी: nagpuronline.com — NMC portal. Property records, assessment records.

Other Cities: dlr.maharashtra.gov.in — Department of Land Records, Maharashtra. Offline City Survey Office ला visit करा.

4. Sale Deed (खरेदीखत) — Verification Process

Sale Deed हे property खरेदीचे सर्वात महत्त्वाचे legal document आहे. Registration Act 1908 नुसार ₹100 पेक्षा जास्त मूल्याच्या immovable property चे sale deed Sub-Registrar कडे mandatory register करणे आवश्यक आहे.

4.1 Sale Deed Verification Steps

Index II तपासा: Sub-Registrar Office मध्ये Index II मध्ये property चे सर्व registered transactions दिसतात. Property च्या Survey Number/City Survey Number वरून search करा. गेल्या 30 वर्षांचे सर्व transactions check करा.

Document Number Verify करा: Sale Deed वरील Document Number Sub-Registrar Office च्या records मध्ये जुळतो का ते verify करा. This is a foolproof method.

Seller Identity Verify करा: Seller चे नाव, Aadhaar number, PAN number Sale Deed शी जुळते का? Biometric verification registration वेळी होते — हे आता mandatory आहे.

Stamp Duty Paid Verify करा: Stamp Duty योग्य rate नुसार भरली आहे का? कमी stamp duty भरणे हे under-valuation fraud चे sign आहे.

4.2 Sale Deed मध्ये असायला हवे — Checklist

5. Encumbrance Certificate (EC) — कर्जबाजारी तपासणी

Encumbrance Certificate (EC) हे एक अत्यंत महत्त्वाचे document आहे जे सांगते की property वर कोणतेही financial liabilities (mortgages, liens, charges, court attachments) आहेत का. Property खरेदी करण्यापूर्वी EC काढणे mandatory आहे.

5.1 EC मध्ये काय दाखवले जाते?

Property वर असलेले सर्व registered mortgages (तारण)
Bank loans (Home Loan, Mortgage Loan)
Court orders, attachments
Sale deeds — मागील सर्व registered transactions
Registered lease agreements
Gift deeds, partition deeds

⚠️ EC ची मर्यादा — महत्त्वाचे!

EC केवळ Registered encumbrances दाखवते. Unregistered mortgages, oral agreements, किंवा recent bank loans EC मध्ये लगेच दिसत नाहीत. त्यामुळे EC सोबत Bank NOC आणि direct bank verification पण करा.

5.2 EC कसे मिळवावे?

Online (iGR Portal): igrmaharashtra.gov.in वर जा → Services → Encumbrance Certificate → Property details enter करा → EC download करा.

Offline (Sub-Registrar Office): Form 22 भरा, Property details द्या, fees भरा (₹200-500). 3-7 दिवसांत EC मिळते.

Period: कमीत कमी 30 वर्षांचा EC मागवा. Home Loan साठी banks 13 वर्षांचा EC मागतात — परंतु buyers ने 30 वर्षांचा EC घ्यावा.

5.3 EC Analysis — कसे वाचावे?

Multiple Sale Deeds	Property अनेकदा विकली गेली आहे	Chain of title verify करा. Last registered deed च valid आहे.
Lease Agreement	Property भाड्याने दिली आहे	Lease terms जाणून घ्या. Tenant ला possession द्यावा लागेल का?

6. RERA Verification — Builder Project Check

Real Estate (Regulation and Development) Act, 2016 — RERA — हे buyer protection साठी landmark कायदा आहे. Maharashtra RERA (MahaRERA) ही देशातील सर्वात active RERA authority मानली जाते.

6.1 RERA Verification — काय तपासावे?

Project Registration Verify करा: maharera.mahaonline.gov.in वर project RERA number enter करा. Project registered आहे का, Registration valid आहे का, Registration expired तर नाही ना?

Project Details Check करा:

Project name, location, total units
Completion date (promised vs. actual)
Total registered units vs. sold units
Amenities promised
Escrow account details

Quarterly Updates Check करा: Builder ने quarterly progress reports RERA portal वर upload केल्या आहेत का? Updates नसणे = project slow किंवा stalled.

Complaints History: त्या project किंवा builder विरोधात past complaints आहेत का? Orders passed आहेत का?

Agent Registration: Property agent/broker RERA registered आहे का? Unregistered agents illegal आहेत.

6.2 RERA अंतर्गत Buyer चे अधिकार

Defect Liability	Section 14	Possession नंतर 5 वर्षांत structural defects आढळल्यास builder ने free repair करणे बंधनकारक.
Document Access	Section 11	Builder ने project documents, approvals, layout plans RERA portal वर upload करणे mandatory.
Escrow Account	Section 4(2)(l)	70% funds separate escrow account मध्ये ठेवणे mandatory. Diversion illegal.
Complaint Filing	Section 31	कोणीही buyer RERA authority कडे complaint file करू शकतो. ₹1,000 fee.

CERSAI (Central Registry of Securitisation Asset Reconstruction and Security Interest) हे bank mortgages ची central registry आहे. Property वर home loan आहे का ते verify करण्यासाठी cersai.org.in वर property details search करा. Property वर existing bank mortgage असल्यास seller ने loan close केल्याशिवाय खरेदी करू नका.

8. Complete Due Diligence Checklist — Property खरेदी करण्यापूर्वी

Due Diligence म्हणजे property खरेदी करण्यापूर्वी केली जाणारी सम्पूर्ण तपासणी. हे एक structured process आहे. खालील checklist property advocate आणि experienced buyers वापरतात.

8.1 Phase 1: Initial Verification (पहिल्या भेटीत)

9. Home Loan Documentation Verification

Home Loan घेताना bank स्वतः property documents verify करते — याचा buyers साठी फायदा म्हणजे bank ने approve केलेल्या property ची basic due diligence झाली आहे असे मानता येते. परंतु bank due diligence हे buyer due diligence ला पूर्णतः replace करत नाही.

💡 Bank Approved Projects — Buyer साठी फायदा

Major banks (SBI, HDFC, ICICI, Axis) ने approved केलेल्या builder projects मध्ये property loan process सोपी होते. Banks स्वतः builder च्या documents verify करतात. परंतु bank approval = fraud-free guarantee नव्हे. IL&FS, DHFL सारख्या cases मध्ये bank approved projects होत्या तरीही buyers फसले. त्यामुळे bank approval + independent verification दोन्ही करा.

10. Mutation (नामांतर) Process — खरेदीनंतर

Property खरेदी झाल्यानंतर Revenue records मध्ये नाव change करणे म्हणजे Mutation (नामांतर). Sale Deed register झाल्यानंतर Mutation अत्यंत महत्त्वाचे आहे — Mutation न केल्यास Revenue records मध्ये जुनाच मालक दिसतो.

10.1 Mutation Process

Application: Registration झाल्यानंतर 3 महिन्यांत Talathi कडे Mutation Application द्या. Documents: Sale Deed copy, 7/12 copy, Application form.

Public Notice: Talathi 30 दिवसांचा public notice लावतो. कोणाचा objection नसल्यास mutation proceed होते.

Circle Officer Approval: Talathi नंतर Circle Officer ची approval. 60-90 दिवसांत mutation complete.

Updated 7/12 Verify करा: Mutation झाल्यावर bhulekh.mahabhumi.gov.in वर check करा — तुमचे नाव 7/12 वर आले आहे का?

⚠️ Mutation विलंब — धोके

Mutation उशिरा केल्यास: (1) Property पुन्हा दुसऱ्याला विकण्याची संधी Seller ला राहते, (2) Revenue records मध्ये तुम्ही मालक म्हणून दिसत नाही, (3) Property Tax notices जुन्या मालकाला जातात. Mutation लगेच करा — 3 महिन्यांत mandatory.

11. Professional Title Search — Advocate कडून

Property Lawyer (Advocate) कडून केलेला Professional Title Search हे property खरेदीतील सर्वात महत्त्वाचे step आहे. यात Advocate गेल्या 30+ वर्षांचे सर्व documents, records, आणि court orders तपासतो.

11.1 Title Search Report मध्ये काय असते?

Encumbrances: EC आणि CERSAI records वरून mortgages, liens
Litigation Status: Court records, pending cases

Title Opinion: Advocate चे final opinion — Title Clear / Title Doubtful / Title Defective

11.2 Title Search साठी Advocate कसा निवडावा?

Local Bar Association कडून Property Law specialist advocate शोधा — experience 10+ वर्षे असावे

Bank ने नेमलेला Advocate विचारा — Home Loan च्या वेळी banks panel advocates वापरतात

Advocate ने written Title Opinion द्यावे — verbal opinion नाही

Fee: Title Search Report — ₹5,000 ते ₹25,000 (property value नुसार). हे investment आहे, खर्च नाही.

12. Document Fraud Red Flags — सावध करणारे Signs

Documents तपासताना खालील red flags दिसल्यास तात्काळ सावध व्हा आणि professional help घ्या:
