भारतात दर तीन मिनिटांनी एक घरगुती हिंसेची घटना घडते — पण त्यातील बहुतांश तक्रारच होत नाही. NFHS-5 (2019-21) नुसार भारतातील 31.9% विवाहित महिलांनी घरगुती हिंसा अनुभवली आहे. “घरची गोष्ट घरातच राहू दे” ही मानसिकता बदलण्यासाठी कायदा आहे — Protection of Women from Domestic Violence Act, 2005 (PWDVA). 2025 मध्ये या कायद्याने 20 वर्षे पूर्ण केली.

DV Act 2005 — इतिहास, उद्देश आणि 20 वर्षे पूर्ण
Protection of Women from Domestic Violence Act, 2005 (PWDVA) हा September 13, 2005 रोजी भारतीय संसदेने अधिनियमित केला. October 26, 2006 पासून देशभर अंमलात आला. 2025 मध्ये या कायद्याने 20 वर्षे पूर्ण केली. Ajmal IAS Academy, September 13, 2025
कायदा का आणला?
IPC 498A (आता BNS 85) हा criminal law होता — फक्त तुरुंगवास. पण घरगुती हिंसेसाठी civil remedies — Protection Orders, Residence Rights, Maintenance — यांची गरज होती. PWDVA हे gap भरतो. हा कायदा IPC 498A पूरक आहे, replacement नाही.

- विवाहित महिला — पती आणि सासरच्या घरातील लोकांविरुद्ध

DV Act Section 3 — “Domestic Violence” ची व्यापक व्याख्या देतो. फक्त मार नाही — खालील सर्व 5 प्रकार DV Act Section 3 खाली येतात:
शारीरिक (Physical)
मारणे, लाथ मारणे, जखम करणे, शस्त्राने हल्ला, आम्ल हल्ला, बेड्या घालणे, खोलीत डांबणे, गळा दाबणे. शरीराला इजा होणे किंवा होण्याचा धोका.
लैंगिक (Sexual)
Marital rape (वैवाहिक बलात्कार), अपमानास्पद लैंगिक वागणूक, Pornography साठी बळजबरी, लैंगिक स्वायत्ततेचे उल्लंघन.
भावनिक / तोंडी (Emotional/Verbal)
शिव्या, अपमान, वारंवार अपमानास्पद बोलणे, मुलांपासून दूर करण्याची धमकी, आत्महत्येची धमकी, मानसिक यातना.
आर्थिक (Economic)
पैसे न देणे, नोकरी करू न देणे, bank account बंद, property access नाकारणे, jobless ठेवणे. SC Shabnam Bano (2024) ने confirmed.
Digital Abuse
Cyber harassment, Morphed images, Online stalking, WhatsApp threats, GPS tracking — Bombay HC 2025 ने DV Act खाली valid मान्य.

Section 3, Explanation I — Dowry demands — हुंड्याची मागणी करणे, त्यासाठी दबाव आणणे — हे देखील घरगुती हिंसा आहे. PWDVA 2005 Bare Act
Shared Household म्हणजे काय?

DV Act — ६ प्रकारचे Legal Orders
Protection Order
आरोपीला घरात येण्यास, phone/email/personal contact करण्यास बंदी. Workplace, school, neighbors ना contact बंदी. सर्वात महत्त्वाचा Order.
Residence Order
सासरच्या shared household मध्ये राहण्याचा अधिकार. आरोपीने घर सोडण्याचे आदेश. Alternate accommodation. घर पतीच्या नावे असले तरी.
Monetary Relief
Maintenance (पोटगी), वैद्यकीय खर्च, मुलांचे शिक्षण खर्च, नुकसान भरपाई, income loss भरपाई. Inflation adjusted (Anjali Sharma 2023).
Custody Order
मुलांचा तात्पुरता ताबा. Visitation rights define करता येतात. DV असल्यास supervised visitation. Passport impound शक्य.
Compensation Order
शारीरिक, मानसिक, आर्थिक नुकसानाची भरपाई. 2023 update — inflation adjustment मान्य. LawCrust 2025
Interim / Ex-Parte Order
आरोपीला notice न देता तात्काळ Order याच दिवशी शक्य. Kerala fast-track — 45 days. SC July 2025
Order Violation — काय होते?
Protection Order किंवा कोणत्याही DV Order चे उल्लंघन = 1 वर्ष तुरुंगवास + ₹20,000 दंड (दोन्ही शक्य). Non-bailable offence. Police ला 100 वर तात्काळ कळवा. PWDVA 2005 Section 31
Protection Order कसे मिळवावे? — Step by Step Process
Protection Officer (PO) शी संपर्क
प्रत्येक जिल्ह्यात Protection Officer (PO) नेमणूक DV Act Section 8 अन्वये बंधनकारक. WCD (Women & Child Development) District Office मध्ये PO कार्यालय. Domestic Incident Report (DIR) भरण्यात PO मदत करतो.
💡 PO ची सेवा पूर्णपणे मोफत. Documents नसले तरी DIR भरता येते.DIR — Domestic Incident Report (Form I)
PO Form I भरण्यात मदत करतो. घटनांचे वर्णन (dates, incidents), evidence list, witnesses नमूद करा. DIR — official record जो court मध्ये valid evidence म्हणून वापरला जातो.
NALSA (15100) — मोफत वकील
NALSA National Legal Services Authority — 15100 वर call करा. DV Application (Section 12) तयार करतात. Documents नसले तरी चालतात. SLSA / DLSA मार्फत direct मदत.
💡 Bombay HC 2025 — Virtual evidence वापरून e-filing शक्य. Court ला जाणे optional for initial stages.Magistrate कडे Application — Section 12
कोणत्याही Magistrate Court मध्ये. Jurisdiction ची अट नाही — पीडितेच्या राहत्या जागेजवळ, नोकरीच्या ठिकाणाजवळ, किंवा हिंसा झालेल्या ठिकाणी. Application मध्ये कोणते orders हवे ते स्पष्ट लिहा.
Ex-Parte Interim Order — तात्काळ संरक्षण
Section 23 — आरोपीला notice न देता याच दिवशी order शक्य. Life/limb धोक्यात असल्यास Court immediate order देते. Interim order final order येईपर्यंत valid राहतो.
⏱️ Same day order शक्य — emergency मध्ये.First Hearing — ३ कार्यदिवसांत
DV Act Section 12(4) mandate — application नंतर 3 working days मध्ये hearing. Section 14 — Magistrate counselling order देऊ शकतो. पण counselling — mandatory नाही जर सुरक्षिततेचा धोका असेल.
Final Order — 60 दिवसांचा mandate
DV Act Section 12(5) — 60 days मध्ये final order. Reality: Mumbai courts मध्ये 8-14 महिने. Fast-track courts साठी आग्रह धरा. Order violation = Section 31 — 1 वर्ष तुरुंगवास.

विवाहाच्या 7 वर्षांत हुंड्यासंबंधी क्रूरतेमुळे किंवा छळामुळे पत्नीचा मृत्यू. Burns, bodily injury किंवा abnormal circumstances. पती + सासरचे — सर्व जबाबदार.
Presumption of Guilt: पीडितेच्या मृत्यूपूर्वी हुंड्याची मागणी किंवा छळ सिद्ध झाल्यास — आरोपीला स्वतःला निर्दोष सिद्ध करावे लागते.
किमान ७ वर्षे → आजीवन कारावास | Non-Bailable | CognizableAbetment of Suicide — आत्महत्येस प्रवृत्त करणे
छळामुळे पत्नीने आत्महत्या केल्यास. 7 वर्षांत झाल्यास “presumption of abetment” लागू.
10 वर्षे ते आजीवनDowry Prohibition Act 1961
हुंडा घेणे आणि देणे — दोन्ही गुन्हा. Demand alone — sufficient. “Gifts” म्हणून disguise केले तरी.
५ वर्षे + किमान ₹१५,०,०० दंडहुंडाबळी FIR — Zero FIR कुठे?
- कोणत्याही Police Station — Zero FIR शक्य
- महिला पोलीस अधिकाऱ्याने नोंदणी बंधनकारक
- Evidence: Post-mortem report, Witness statements, Dowry demand evidence

वैवाहिक क्रूरता — BNS 85 (IPC 498A)
वैवाहिक क्रूरता — व्याख्या
पती किंवा नातेवाइकांनी: (A) हुंड्यासाठी शारीरिक/मानसिक क्रूरता, (B) आत्महत्येस प्रवृत्त करणे, (C) आरोग्याला गंभीर धोका. Ongoing pattern of behavior — एकच घटना पुरेशी नाही असे काही courts म्हणतात.
३ वर्षांपर्यंत + दंड | Non-Bailable | CognizableBNS 85 — Criminal complaint (FIR, तुरुंगवास). DV Act Section 12 — Civil complaint (Protection Order, Maintenance, Residence). दोन्ही एकत्र file करता येतात. एक दुसऱ्यावर अवलंबून नाही. SC ने confirmed.
